Current Visa Numbers

June 2008

The June Visa Bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4231.html) shows forward movement for the EB-2 category only (China – mainland born and India). These categories have moved forward by three months. The State Department has commented on the visa availability as follows:

Demand for numbers, primarily by Citizenship and Immigration Services Offices for adjustment of status cases, is expected to bring the Employment Third preference category very close to the annual numerical limit in June. As a result, this category is likely to experience retrogressions or visa unavailability beginning in July. Such action would only be temporary, however, and a complete recovery of the cut-off dates would occur for October, the first month of the new fiscal year.

Additional Notes on Visa Numbers

  • Applicants with an approved immigrant petition (I-140) can apply for adjustment of status once the visa number reaches their "priority date" (the date on which their labor certification was received by the State Employment Department).
  • The monthly progress of visa numbers is highly unpredictable. They can and do move forward or backward, and therefore cannot be used to estimate one's waiting time.

The EB1 (employment based immigrant first preference) category includes "outstanding researchers," multi-national executives and mangers, and "extraordinary ability" persons.

The EB2 category includes persons whose jobs require an advanced degree and "exceptional ability" persons.

The EB3 category includes all other employment-based immigrants.
