State Department Announces Advancement Of Priority Date Cutoffs For December

November 10, 2005 – The State Department today released the December Visa Bulletin, announcing advancement of priority date cutoffs for many employment based immigrant visa categories, including India and China.  (See the summary chart below.)  Individuals with a filed or approved 140 petition, and whose priority dates are on or earlier than the cutoff dates announced for December will be eligible to file their adjustment of status applications during the month of December 2005.  Pending adjustment applications may be approved for individuals whose priority dates are on or earlier than the announced cutoff dates if all other requirements including the necessary background security checks have been completed.

The State Department advises that movement of priority date cutoffs may be “sporadic, and eventually slow or stop later in the fiscal year.  At this time, it is not possible to predict the rate of movement in future months.”
