May 17, 2002 - An Immigration and Naturalization
Service ("INS") memo issued on May 9, 2002 significantly expanded
security check procedures for foreign nationals. The announced
security check procedures require that the identities of all
applicants be checked against the Interagency Border Inspection
System (IBIS) database containing criminal information and
immigration records supplied by various federal agencies.
These security check procedures apply to all benefit applications,
such as H petitions and residence applications, even those
well into the processing stage. While some INS offices have
reported that no processing delays are expected, others have
indicated that a three to four week delay will occur until
the appropriate technology and training to use the IBIS system
is implemented.
Based upon the scattered and imprecise information provided
by the INS and the press, it is not yet possible to determine
the extent of possible delays. Berry, Appleman & Leiden is
closely monitoring this situation and will provide updates
as they are received.
