Electronic LCA Filing for H-1B Petitions Arrives

 

January 10, 2002 - As previously reported on our website (http://www.usabal.com/news/2001/01dec5.html), implementation of the Labor Department's new program for electronic filing of Labor Condition Applications (LCAs) will take effect on Monday, January 14, 2002.

Starting Monday, LCAs may be filed with the Labor Department via the World Wide Web, rather than through fax transmission. As a result, we hope to experience a dramatic processing improvement.

Because LCA forms may be filed electronically over the Web, it will no longer be necessary for your attorneys to send hard copies of LCA documents for your signature. Correspondingly, your attorneys will not need to wait for signed LCA documents before filing the application. Rather, your attorney can file LCAs immediately. BAL will provide our clients with complete instructions which include procedures for placement of the two posting notices prior to filing.

Since the Labor Department's first announcement of this new program, BAL has revised LCA procedures to take advantage of this expedited process. Going forward, BAL clients can expect to utilize the new "electronic" LCA filing system.
