Department of Labor Releases New Regulations for H-1B Employer

January 19, 2001 -Beginning on January 19, 2001 all H-1B employers must abide by new requirements issued by the Department of Labor.

The new regulations require all H-1B employers to determine whether they are “H-1B dependent.”  This obligation arises every time an LCA is filed or utilized by a company.  If dependent, employers must attest to a variety of conditions regarding the employment of H-1B professionals.

If you believe your company may be H-1B dependent and you have retained BAL as your immigration attorneys, please contact us immediately so that we may determine your best course of action.

Below we provide a summary of key features of the new regulations for your review.  Please feel free to contact BAL if you have questions regarding these new regulations.
